Terms of Use of Red Cable Pro Referral Program

  • Acceptance of the Terms of Use

    These terms of use are entered into by and between You and MOBITECH CREATIONS PRIVATE LIMITED (“Company”, “we”, or “us”). The following terms and conditions (“Terms of Use”), govern your access to and use of the Red Cable Pro Referral Program on the OnePlus device.

    Please read the Terms of Use carefully before you start to use Red Cable Pro service. By clicking “accept” or “agree” to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy found at https://www.oneplus.in/legal/privacy-policy and incorporated herein by reference.

    By using Red Cable Pro Referral Program, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use Red Cable Pro Referral Program.

    Eligibility

    Anyone who meets all of the following conditions is eligible to participate in the OnePlus Red Cable Pro Referral Program:

    1. Has a valid OnePlus Account ID;
    2. Purchased a OnePlus smartphone.
    3. Linked the Device on Red Cable Club

    Sharing Referrals

    Referrals should only be used for personal and non-commercial purposes, and only shared with personal connections that will appreciate receiving these invitations. Referral should not be distributed where there is no reasonable basis for believing that all or most of the recipients are personal friends (such as voucher websites, Reddit, or Wikipedia).

    Basic Rule

    For Red Cable Pro users:

    1. Currently one Red Cable Pro user only has 2 invites to refer. The 2 invites will exhaust regardless of the referee having subscribed successfully or not.
      2. Red Cable Pro user needs to enter non-Pro user's OnePlus account. The OnePlus account can support both email and phone number which is under valid status.

    3.The referral valid period is one year.

    For non-Pro:
    1. The OnePlus account can support both email and phone number. Please ensure that the account shared with your friends is correct. OnePlus does not hold responsibility in case the invite is directed towards another user.

    1. The validity period of a referral is one year. Non-Pro users need to subscribe within this validity period to avail their discount. No

    3.The validity period begins from the date when the user successfully subscribes.

    Rewards

    For Red Cable Pro users:

    1. Inviting one user successfully will get the Red Cable Pro user 200 RedCoins.
      Please note that a successful invitation is only valid on purchases made via Red Cable Club section in Settings. Purchases made on other channels(e.g.redemption channel) are not applicable for referral rewards.
      2. The RedCoins rewards will be added to your account automatically after the referee subscribes to Red Cable Pro membership successfully. Please turn to Red Cable Prive to check the RedCoins details.

    For non-Pro:

    1. After your referral has been recorded successfully, you will get 30% off with Care plan and 20% off with Life plan. You can choose the desirable plan and discount will be affect directly without any operations.

    Modification of RedCoins and the value of discount

    OnePlus may modify the RedCoins of each referral and the value of discount after posting on the OnePlus website, which are effective upon announcement.

    Multiple referrals

    The friend referred to the Program may only use limited number of referrals. OnePlus may modify the number based on the operation strategy change.

    Privacy Policy

    The relationship data between Red Cable Pro users and the referred friends will be stored by OnePlus and visible to Red Cable Pro users. The information includes who has used the referral and points awarded for each referral.

    Personal information we collect may be used for administering the Red Cable Pro Referral Program ("Program") and will only be used for the purposes stated in these Terms and Conditions or other directly related purposes. In addition, you expressly agree to our collection and usage of your personal information for the purposes of administering and operating the Program. Our Privacy Policy [https://www.oneplus.in/legal/privacy-policy] will apply to this Program and to all personal information collected in this Program.

    Severability

    If any provision in these terms are held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions.

    Termination

    OnePlus may suspend or terminate the Referral Program or a user’s ability to participate in the Referral Program at any time for any reason.

    We reserve the right to suspend accounts or remove points if we notice any activity that we believe is abusive, fraudulent, or in violation of the OnePlus Terms of Service. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals in our sole discretion as deemed fair and appropriate.

    The scope, variety, and type of services and products that you may obtain by redeeming points can change at any time.

    Changes to the Terms of Use

    We may revise and update these Terms of Use from time to time in our sole discretion, including pricing and any benefits extended. All changes are effective immediately when we post them and apply to all access to and use of Red Cable Pro Referral Program thereafter. 

    Your continued use of Red Cable Pro Referral Program following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check the ‘Terms of Use’ available in the ‘About’ section under the ‘Red Cable Pro Referral Program settings’ from time to time so you are aware of any changes, as they are binding on you.

    Accessing Red Cable Pro Referral Program and Account Security

    We reserve the right to withdraw or amend these Terms of Use and any service we provide on Red Cable Pro Referral Program, in our sole discretion without notice. We will not be liable, if, for any reason, all or any part of Red Cable Pro Referral Program is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Red Cable Pro Referral Program, or the entire service, at our sole discretion.

    You are responsible for both:

    • Making all arrangements necessary for you to have access to Red Cable Pro Referral Program.
    • Ensuring that all persons who access Red Cable Pro Referral Program through your internet connection are aware of these Terms of Use and comply with them.

    You agree that all information on your device that forms part of the results on Red Cable Pro Referral Program is governed by our Privacy Policy and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

    Intellectual Property Rights

    Red Cable Pro Referral Program and its entire service, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company or its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

    These Terms of Use permit you to use Red Cable Pro Referral Program for your personal, non-commercial use only.

    No right, title, or interest in or to Red Cable Pro Referral Program is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of Red Cable Pro Referral Program not expressly permitted by these Terms of Use is a breach of these Terms of Use and may violate copyright, trademark, and other laws.

    Trademarks

    Red Cable Pro Referral Program and any related logos are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company or its licensors. All other names, logos, product and service names, designs, and slogans on Red Cable Pro Referral Program are the trademarks of their respective owners.

    Prohibited Uses

    You may use Red Cable Pro Referral Program only for lawful purposes and in accordance with these Terms of Use.

    Reliance on Information

    Indemnification

    You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of any information obtained from Red Cable Pro Referral Program.

    Governing Law and Jurisdiction

    All matters relating to Red Cable Pro Referral Program and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of India without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or Red Cable Pro Referral Program shall be instituted exclusively in the competent courts of Bangalore, India. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

    Waiver and Severability

    No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

    If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

    Entire Agreement

    The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and MOBITECH CREATIONS PRIVATE LIMITED regarding Red Cable Pro Referral Program and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding Red Cable Pro Referral Program.

    4. What is the validity of the Prime Promo Code?

    6. As an existing Prime member am I also eligible for this offer?

    9. How do I cancel Amazon Prime?

    Amazon prime membership is available for 3 months at no additional cost through Prime promo code plan. If you wish to cancel your subscription, visit ‘Manage Your Prime Membership’ page to end your membership. Cancellation of the membership will lead to loss of all these benefits.
